29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):    (a)Hulstein Excavating Inc. at 4th Street between Minnesota and Main Avenue, Sioux Falls, SD 57105:  On or about and at times prior to April 8, 2020, the employer did not ensure employees working in an excavation were protected from cave-in hazards. Employees were installing a sewer line within a trench excavation approximately 10 feet deep while their means of egress was outside the protective system. This condition exposed employees to crushing hazards associated with a trench wall collapse.    (b)Hulstein Excavating Inc. at 4th Street between Minnesota and Main Avenue, Sioux Falls, SD 57105: On or about and at times prior to April 8, 2020, the employer did not ensure employees were protected from cave-in hazards. Employees exited and stood outside the trench protective system while the trench box was being moved with the excavator bucket. This condition exposed two employees to crushing hazards associated with a trench wall collapse.    Hulstein Excavating, Inc. was previously cited for violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1263448, citation number 1, item number 2 and was affirmed as a final order on December 13, 2017, with respect to a workplace located at Dakota Street, Canton, SD 57013.
