OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall, struck-by and caught-between hazards: (a)Hulstein Excavating Inc, at West Main Street and North 8th Street, Beresford, SD 57004: On or about and at times prior to August 19, 2025, the employer allowed an employee to ride in or on the bucket of a Komatsu Model: 6NB41E excavator as a means to enter and exit a trench. This condition exposed the employee to fall, struck-by, and caught-in-between hazards. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard can be found in SAE J153, Surface Vehicle Recommended Practice, Section 4.2 Operator- General Precautions, instructs operators: "Do not permit riders on the machine if there are no manufacturer's designated place for a rider."

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a)Hulstein Excavating Inc, at West Main Street and North 8th Street, Beresford, SD 57004: On or about and at times prior to August 19, 2025, the employer did not ensure a competent person inspected the excavation prior to start of work and during each shift, in that the competent person did not identify and/or correct the lack of an appropriate protective system, spoils piles not set two feet back from the edge of the trench, employees allowed to ride in the excavator bucket, and no suitable means to egress was given to employees. This condition exposed employees to cave-in hazard and struck by hazards.
