29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  a) New residential construction located on Lot #94, West side of the structure: On or about 04/22/2020, and at times prior, the employer exposed employees to falls to the lower levels of scaffold, in that work platforms on the scaffold were not fully planked as employees were engaged in brick installation activities.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) New residential construction located on Lot #94, West side of the structure: On or about 04/22/2020, and at times prior, the employer exposed employees to falls over 33-feet, 6-inches to the lower level as a fall protection system was not provided while installing bricks on a new chimney from a tubular welded scaffold system.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) New residential construction located on Lot #94, Upper roof: On or about 04/22/2020, and at times prior, the employer exposed employees to falls of 33-feet, 6-inches to the lower level, in that a fall protection system was not provided while installing bricks using the 8/12 pitched roof as a walking/working surface.
