29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: (a) On April 17, 2020, for the employees exposed to fall hazards of approximately 10 feet where an extension ladder extended only a few inches above the roofline, was resting against a gutter and had no grasping device provided at or near 136 Libby Road in Lincoln, North Dakota.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On April 17, 2020, for the employees exposed to fall hazards of approximately 10 feet without fall protective systems in place at or near 136 Libby Road in Lincoln, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1430664, Citation 1, Item 1, and was affirmed as a final order on February 19, 2020, with respect to a workplace located at 6415 McCurry Way in Lincoln, North Dakota.
