29 CFR 1910.134(c)(1)(ix): The written respiratory protection program did not contain procedures for regularly evaluating the effectiveness of the program: a) Workplace, 3 North, 1 Clara Maass Drive, Belleville, NJ The effectiveness of the employer's written respiratory protection program was not regularly evaluated in that employees, including nurses, were required to use surgical masks during the treatment and care of patients, including those under investigation for and/or confirmed as positive for COVID-19. During such operations, employees were not provided with a NIOSH-approved respirator such as an N-95 respirator to protect them from infection by the SARS-CoV-2 virus. Violation occurred on or about March 24, 2020 to March 30, 2020.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident: a) Workplace, 1 Clara Maass Drive, Belleville, NJ An employee who worked as an registered nurse in Unit 3 North and provided direct care to patients under investigation for and/or confirmed as positive for COVID-19, died of SARS-CoV-2 Coronavirus Disease on April 15, 2020. The employer did not report the fatality to OSHA until April 24, 2020 despite learning of it on April 17, 2020. Violation determined on or about April 17, 2020.
