29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): a) Extended Stay America, located at 3000 George Busbee Pkwy. NW, Kennesaw, GA, North side parking area: On or about 04/27/2020, the employer exposed employees to struck-by hazards, in that employees of the company were operating a JCB Model 550-170 All Terrain Forklift Truck without first receiving training and certifications to operate this equipment. Uncertified operators were in close proximity to others working on the ground area below near ladders used to access the roof.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) Extended Stay America, located at 3000 George Busbee Pkwy. NW, Kennesaw, GA, Roof: On or about 04/27/2020, the employer exposed employees to fall hazards of approximately 28-feet to the lower level, in that employees were not using a fall protection system while engaged in roofing activities on a 6/12 pitched commercial roof. Associated Roofing & Contracting Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1109364, citation number 1, item number 1 and was affirmed as a final order on 01/05/2016, with respect to a workplace located at 1827 Center Point Drive, Naperville, IL 60563.
