On or about May 6, 2020, located at 12740 Beverhymer Road in Westerville, Ohio, the employer did not instruct the employees in the recognition and avoidance of unsafe conditions and the regulations applicable to framing work, thereby exposing the employees to struck-by and fall hazards.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about May 6, 2020, located at 12740 Beverhymer Road in Westerville, Ohio, employees were operating pneumatic nail guns without any means of eye protection, thereby exposing the employees to struck-by hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about May 6, 2020, located at 12740 Beverhymer Road in Westerville, Ohio, employees were installing joists while standing on the top plate during the framing of a residential home without any means of fall protection, thereby exposing the employees to a fall of approximately 10-12 feet.  b. On or about May 6, 2020, located on the first floor at a residential home at 12740 Beverhymer Road in Westerville, Ohio, there was a floor hole that was approximately 8 foot wide by 10 foot long without guardrails or any other protection to keep employees from falling approximately 10 feet.   Ibrahim Aboomer, dba Framing and Carpentry Service, LLC. was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection number 1203862, citation number 1, item number 1 and was affirmed as a final order on April 18, 2017, with respect to a workplace located at 3840 Oxford Loop West New Albany, Ohio 43054.
