29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.   a) Jerry Lopez, at a jobsite located at 909 Peacock Drive, Sunbury, Ohio 43074: On and/or preceding May 27, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to a personal protective equipment program and a fall protection program for employees conducting roofing work.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.   a) Jerry Lopez, at a jobsite located at 909 Peacock Drive, Sunbury, Ohio 43074: On and/or preceding May 27, 2020, the employer failed to train employees on the common hazards found in residential construction or the regulations required to control or eliminate the hazards. Employees conducting roofing work were exposed to struck-by hazards and fall hazards.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Jerry Lopez, at a jobsite located at 909 Peacock Drive, Sunbury, Ohio 43074: On and/or preceding May 27, 2020,  the employer failed to ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Roofers were installing shingles while using a pneumatic nail gun. The employees were not utilizing eye protection, which exposed them to struck-by hazards to the eyes.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    a) Jerry Lopez, at a jobsite located at 909 Peacock Drive, Sunbury, Ohio 43074: On and/or preceding May 27, 2020, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were roofing the second story roof without any means of fall protection, thereby exposed to fall hazards of up to 20 feet.  b) Jerry Lopez, at a jobsite located at 909 Peacock Drive, Sunbury, Ohio 43074: On and/or preceding May 27, 2020, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were roofing the second story roof with non-safety fall protection equipment, thereby exposed to fall hazards of up to 20 feet.

29 CFR 1926.502(e)(2): Positioning devices shall be secured to an anchorage capable of supporting at least twice the potential impact load of an employee's fall or 3,000 pounds (13.3 kN), whichever is greater.  a) Jerry Lopez, at a jobsite located at 909 Peacock Drive, Sunbury, Ohio 43074: On and/or preceding May 27, 2020, the employer failed to ensure anchorages were capable of supporting at least twice the potential impact load of an employee's fall or 3,000 pounds. Employees used ropes tied around trusses on the roof for positioning, thereby exposed to fall hazards of up to 20 feet.
