29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.  Located at Lot 178, Old Bay Drive, Pataskala, Ohio:  On or about June 03, 2020, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, while employees performed roofing work onsite.  One employee had worked unprotected on top of the second floor roof top as they installed roofing felt to the top of the OSB sheathing.  The fall distance was 12 feet 1 inch from the roof top eave to the ground level.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a.  Located at Lot 178, Old Bay Drive, Pataskala, Ohio:  On or about June 03, 2020, the employer failed to instruct an employee on the avoidance of unsafe conditions, while he installed roofing felt to a new build residential construction home.  The employee worked unprotected on top of garage roof top as he installed roofing felt.  The employee's fall distance was 12 feet 1 inch from the roof top eave to the ground level.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.   a.  Located at Lot 178, Old Bay Drive, Pataskala, Ohio:  On or about June 03, 2020, the employer failed to ensure that an employee who worked from the garage roof top of a new build residential home was protected.  The employee installed felt to the garage roof on top of the OSB sheathing near the eave.  The employee was exposed to a fall distance of 12 feet 1 inch from the roof top eave to the ground level.
