29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared: a. On July 28, 2020, an employee operating a saw on the production floor was exposed to noise at 82.2% of the permissible daily dose, or an average sound level of 88.7 DBA, as measured over 468 of sampling. This dose is equivalent to an 8-hour TWA exposure of 88.5 DBA accounting for the period of 12 minutes unmonitored. b. On July 28, 2020, an employee performing hand work on the production floor was exposed to noise at 116.5% of the permissible daily dose, or an average sound level of 91.3 DBA, as measured over 462 of sampling. This dose is equivalent to an 8-hour TWA exposure of 91.1 DBA accounting for the period of 18 minutes unmonitored. Audiograms have not been conducted for employees exposed to noise at an 8 hour time-weighted average above 85 decibels.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: On or about June 4, 2020, where employees were required to perform tasks including but not limited to changing saw blades on the BACA SawJet which has multiple sources of power including electrical and high pressure water, the employer had not developed specific procedures on how to lock out the equipment.
