29 CFR  OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, a worker was exposed to the unprotected point of operation (rotating mixing blades ) of a cement mixer:  (a)  Bridge Deck, Concrete Mixer Staging Area - On or about June 4, 2020, employee was exposed to the rotating blades of an operating cement mixer while attempting to remove concrete debris which prevented the mixer's hopper doors from closing.  Or, in the alternative:  29 CFR 1926.20 (b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part.   (a) Bridge Deck, Concrete Mixer Staging Area - On or about June 4, 2020, employee was exposed to the rotating blades of an operating cement mixer while attempting to remove concrete debris which prevented the mixer's hopper doors from closing while the blades' drive mechanism was not either locked out or tagged in advance of the maintenance activity.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
