29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a)H & W Contracting, LLC at 271 Street & Hwy 115, Harrisburg, SD 57032: On or about and at times prior to June 11, 2020, the employer did not ensure that employees conducting work in an excavation were protected from cave-in hazards. Employees were attempting to tie in a four-inch city water line into a two-inch rural water service in an excavation that varied in depth from approximately seven feet to eleven feet which lacked an adequate protective system, such as sloping, benching, or shielding system. This condition exposed employees to cave-in hazards within an excavation seven to eleven feet deep. H & W Contracting L.L.C. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926. 652(a)(1) which was contained in OSHA inspection number 1407469, citation number 1, item number 1a and was affirmed as a final order on 10/1/2019 with respect to a workplace located at 69th Street & Medical Court Sioux Falls, SD 57107.
