29 CFR 1926.451(b)(5)(ii): Each platform greater than 10 feet in length shall not extend over its support more than 18 inches (46 cm), unless it is designed and installed so that the cantilevered portion of the platform is able to support employees without tipping, or has guardrails which block employee access to the cantilevered end.  On or about June 11, 2020, employees working on siding a two story residential apartment complex located at 2201 Riverview Dr. Green Bay, WI 54303 were working from a ladder jack scaffold platform which extended over 18 inches past its support.  The cantilevered portion of the platform was not supported to prevent tipping and was not provided guardrails to block employee access.  Rhyo Siding & Restoration Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1369471, citation number one, item number three, and was affirmed as a final order on August 26, 2019, with respect to a workplace located at 364-372 S. Jewel Ct. Palatine, IL 60074.

Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On or about June 11, 2020, employees working on siding a two story residential apartment complex located at 2201 Riverview Dr. Green Bay, WI 54303 were exposed to fall hazards of approximately 11 feet while working on unguarded second story balconies with no form of fall protection.  Rhyo Siding & Restoration Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1369471, citation number one, item number five, and was affirmed as a final order on August 26, 2019, with respect to a workplace located at 364-372 S. Jewel Ct. Palatine, IL 60074.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.
