29 CFR  1910.134(d)(1)(iii):The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  On or about 06/15/2020, the employer failed to evaluate decant operation to identify the respiratory hazards that would necessitate, and aid in the selection of appropriate PPE (air purifying masks/respirators).  Employees working within 2.5 feet of the tote opening were exposed to off-gassing created by Nitrogen Dioxide fumes/gases produced by Bright Dip chemicals during the decant process. While in the process of using a one-inch plastic hose to recover sulfuric acid, an employee was only wearing a surgical mask, was overcome by the fumes/gases.

29 CFR  1910.134(d)(3)(i):The employer did not provide a respirator that was adequate to protect the health of the employee under routine and reasonably foreseeable emergency situations:  On or about 06/15/2020, employees tasked with completing Bright Dip operations were not protected from respiratory hazards in that, air purifying masks and/or respirators were not provided to employees when completing tasks such as, but not limited to, holding a one-inch plastic hose to recover sulfuric acid.

On or about 06/26/2020, the employer failed to maintain records of medical evaluations for employees who were required to Self-Contained Breathing Apparatus (S.C.B.A.) when performing Bright Dip decant procedures at the facility. Medical records for six (6) new employees tasked required to wear S.C.B.A.s were not made available for review and/or provided to an OSHA representative when requested.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  On or about 06/15/2020, the company exposed an employee to chemical inhalation hazards from Nitric acid and Aluminum during Bright Dip decant operations due to the company not performing a hazard assessment, not developing safe procedures for the operation, and not training employees on the hazardous conditions or ways to mitigate or abate these hazards.
