29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    On June 17, 2020 at 10609 Shoreview Place in Sister Bay, WI, an employee was utilizing powered hand tools without wearing eye or face protection; pneumatic nail gun and battery circular saw used to install roof sheathing.

29 CFR 1926.451(g)(4)(ii): The top edge height of top-rails or equivalent member on supported scaffolds manufactured or placed in service after January 1, 2000 shall be installed between 38 inches (0.97 m) and 45 inches (1.2 m) above the platform surface.    On June 17, 2020 at 10609 Shoreview Place in Sister Bay, WI, an employee was exposed to a fall hazard thirty-one feet above surface level while standing on the mid-rail of a personnel platform elevated by a Genie GTH 844 Telehandler; climbing on the mid-rail eliminated a top guardrail for a guardrail system.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    On June 17, 2020 at 10609 Shoreview Place in Sister Bay, WI, an employee was working on a roof surface thirty-five feet above surface level without utilizing required fall protection equipment.

29 CFR 1926.503(a)(2)(iii):  The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.  On June 17, 2020 at 10609 Shoreview Place in Sister Bay, WI, the employer had not provided required fall protection safety training for employees working at heights greater than six feet.
