29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) On or about June 19, 2020, employees were exposed to cave-in and/or engulfment hazards where the competent person did not remove employees from hazardous conditions and did not take necessary precautions after sections of the interior walls of the trench had sloughed off into where employees were working.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) On or about June 19, 2020, employees were exposed to cave-in and/or engulfment hazards when working in a trench that was in excess of five feet deep with no protective system in place. CoKan Enterprises Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1420888, citation number 1, item number 2a, and was affirmed as a final order on November 5, 2019, with respect to a workplace located at 1120 N Newport Rd, Colorado Springs, CO, 80916.
