29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: (a)Edwin Henriquez at 1800 South Valley View Road, Sioux Falls, SD 57106: On or about and at times prior to June 19, 2020, the exposing employer did not ensure employees were protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems. Employees were conducting re-roofing operations on a commercial building with a roof pitch of 5-in-12 while not utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately 12 to 20 feet. Edwin Henriquez was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1401550, citation number 1, item number 1, and was affirmed as a final order on November 9, 2019, with respect to a workplace located at 1301 South Keva Avenue, Sioux Falls, SD 57106.
