29 CFR 1910.272(d): The employer did not develop and implement an emergency action plan meeting the requirements contained in 1910.38(a): a) Gerald Grain Center, Inc. located at 3265 County Road 24 in Archbold, Ohio; On or about June 26, 2020 the employer did not develop and implement an emergency action plan as outlined in 29 CFR 1910.38. Employees were exposed to entrapment and engulfment hazards in that the company's emergency action plan did not identify the procedures to be taken in the event of a grain entrapment or engulfment.

29 CFR 1910.147(c)(6)(ii): The employer did not certify that periodic inspections of the energy control procedures had been performed: Gerald Grain Center, Inc. located at 3265 County Road 24 in Archbold, Ohio; On or about June 26, 2020 the employer did not ensure periodic audits of the energy control procedures were certified. Employees were required to enter grain storage bins to perform cleaning which require energy control procedures. Employees were exposed to caught in and engulfment hazards if documented lock out tag procedures are not correctly followed.
