29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Miguel Dominguez, at a jobsite located at 768 Wharncliff, Lot WEL138, Pickerington, Ohio 43062: On and/or preceding June 30, 2020, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Roofers were using pneumatic nail guns to secure the shingles. The employees were not utilizing eye protection, which exposed them to struck-by hazards to the eyes.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  a) Miguel Dominguez, at a jobsite located at 768 Wharncliff, Lot WEL138, Pickerington, Ohio 43062: On and/or preceding June 30, 2020, the employer did not ensure employees used anchorages capable of supporting 5000 pounds while engaged in residential construction activities. Employees were roofing with ropes tied directly around the top of the trusses at the truss nail plate, thereby exposed to fall hazards of up to 20 feet.

29 CFR 1926.503(a)(2): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:   29 CFR 1926.503(a)(2)(ii): The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used.  a) Miguel Dominguez, at a jobsite located at 768 Wharncliff, Lot WEL138, Pickerington, Ohio 43062: On and/or preceding June 30, 2020, the employer did not ensure employees were trained on the correct procedures for erecting a fall protection system while engaged in residential construction activities. Employees were sheathing the roof without an adequate fall protection system, thereby exposed to fall hazards of up to 20 feet.

Miguel Dominguez was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection number 1418200, citation number 1, item number 1, and was affirmed as a final order on August 23, 2019, with respect to a workplace located at 137 Thrush Circle, Pickerington, Ohio, 43147

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a) Miguel Dominguez, at a jobsite located at 768 Wharncliff, Lot WEL138, Pickerington, Ohio 43062: On and/or preceding June 30, 2020, the employer did not ensure employees were adequately protected from falls while engaged in residential construction activities. Employees was installing roofing materials with non-safety rated fall protection equipment, thereby exposed to fall hazards of up to 20 feet.  Miguel Dominguez was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1418200, citation number 2, item number 1, and was affirmed as a final order on August 23, 2019, with respect to a workplace located at 137 Thrush Circle, Pickerington, Ohio, 43147  Miguel Dominguez was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1261589, citation number 1, item number 1, and was affirmed as a final order on 10/10/2017, with respect to a workplace located at 6400 Brandon Drive, Lewis Center, Ohio.
