29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Mario Rodriguez, at a jobsite located at 602 Ludham Trail N/W, Pickerington, Ohio 43147: On and/or preceding June 30, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to a fall protection program for employees conducting framing work.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Mario Rodriguez, at a jobsite located at 602 Ludham Trail N/W, Pickerington, Ohio 43147: On and/or preceding June 30, 2020, the employer did not ensure employees were protected from falls while engaged in residential construction activities. An employee was working on a porch roof without fall protection, thereby exposed to fall hazards of up to 12 feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   a) Mario Rodriguez, at a jobsite located at 602 Ludham Trail N/W, Pickerington, Ohio 43147: On and/or preceding June 30, 2020, the employer did not ensure employees were trained on fall hazards or the required procedures to be followed to minimize the hazards while engaged in residential construction activities. An employee was working on a porch roof without fall protection and did not know and understand the requirements for fall protection, thereby exposed to fall hazards of up to 12 feet.
