29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) Stonegate Construction, Inc. at a worksite located adjacent to Sandy lane, Nelsonville, Ohio 45764: On or preceding June 29, 2020, the employer did not ensure employees were trained on the recognition and avoidance of overhead electrical line hazards or the regulations required to control or eliminate the hazards. Contact between an excavator and the 7,200 volt overhead electrical line resulted in an electrical shock to the employee who was directing the operator of the excavator, resulting in the hospitalization of the employee for 2nd and 3rd degree burns.

29 CFR 1926.600(a)(6): All equipment covered by this subpart shall comply with the following requirements when working or being moved in the vicinity of power lines or energized transmitters, except where electrical distribution and transmission lines have been deenergized and visibly grounded at point of work or where insulating barriers, not a part of or an attachment to the equipment or machinery, have been erected to prevent physical contact with the lines: 29 CFR 1926.600(a)(6)(i): For lines rated 50 kV or below, minimum clearance between the lines and any part of the crane or load shall be 10 feet. a) Stonegate Construction, Inc. at a worksite located adjacent to Sandy lane, Nelsonville, Ohio 45764: On or preceding June 29, 2020, the employer did not ensure an employee who was using an excavator maintained a 10 foot clearance from the excavator and an overhead 7,200 volt electrical line. The contact between the excavator and the line resulted in an electrical shock to the employee who was directing the operator, resulting in the hospitalization of the employee for 2nd and 3rd degree burns.
