29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  On or about July 13, 2020, the employer failed to provide adequate guarding to protect employees from gaining access to the press box opening while operating the Gallard Henning Nopak Baler (Scrap Baler #1, West Location). An employee was exposed to caught-in hazards resulting in partial amputation of one finger.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d)

29 CFR 1910.212(a)(2): General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself.  On or about July 13, 2020, the employer failed to ensure that the guard installed on the Galllard Henning Nopak baler was free from damage that could cause injury to employees.  Employees were exposed to laceration injuries from the sharp, damaged edges of the guard while removing aluminum bales from the equipment.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d)

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:   On or about June 25, 2020, the employer failed to document and utilize hazardous energy (lockout / tagout) control procedures for the Gallard Henning Nopak Baler.  This exposed employees who cleared jams from the equipment to caught-in hazards that could result in serious injury.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.    On or about July 13, 2020, the employer failed to perform periodic inspections of the energy control procedure for the Gallard Henning Nopak Baler machines over the past 2 years. This exposed machine operators to caught-in and amputation hazards due to lack of procedure review and employee competency.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).­­­

29 CFR 1910.147(d): The established procedures for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  On or about June 25, 2020, the employer did not ensure that employees assigned to perform un-jamming tasks on the Gallard Henning Nopak Baler machines were required to apply energy controls in the following sequence:  1) turn off and shut down the machines, 2) physically locate and operate energy isolating devices in such a manner as to isolate the machines or equipment from the energy source(s), 3) affix lockout or tagout devices to each energy isolating device, 4) verify that isolation and deenergization of the machines or equipment have been accomplished.  Machine operators were not affixing lockout or tagout devices or performing verification steps prior to removing the guard and un-jamming aluminum bales on the Gallard Henning Nopak Baler machine.  This exposed employees to caught-in hazards that could result in serious injury.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
