29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about July 20, 2020, during the installation of a waterline vault at a worksite located on 3875 Green Road, Beachwood, Ohio, the employer did not ensure two employees working inside an excavation, with a varying depth of approximately 5.3 to 7 feet, were protected from cave-ins by an adequately designed protection system. The soil would have been classified as; Cohesive Soil, Type B . UNITED EARTHWORKS, LLC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.652(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1459497, CITATION NUMBER 01, ITEM NUMBER 003, AND WAS AFFIRMED AS A FINAL ORDER ON APRIL, 13, 2020, WITH RESPECT TO A WORK PLACE LOCATED AT 7641 WALES AVENUE NW, NORTH CANTON, OHIO.
