29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): a) Leitner-Poma of America Inc., 28194 US Hwy 6 Dillon, CO 80435: On and around 7/20/2020, the employer did not ensure daily inspections of excavations, the adjacent areas, and protective systems, were made by a competent person in order to ensure workers entering the excavation were safe. Employees installing the new ski lift tower at Hole 10 entered the excavation which was 19.9 feet deep on the south side, was sloped to 63 degrees, and had no protective systems in place. Soil on the south wall was crumbling into the excavation. The employees were exposed to struck-by, caught-in, and cave-in hazards.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) Leitner-Poma of America Inc., 28194 US Hwy 6 Dillon, CO 80435: On and around 7/20/2020, the employer did not ensure that employees working inside an excavation with 63 degree walls were protected from cave-in hazards. Employees were installing a new ski lift tower in an excavation approximately 19.9 feet deep on the south side without protective systems in place. This condition exposed employees to a struck-by, caught-in, and cave-in hazards.
