29 CFR 1926.150(c)(1)(vi): A fire extinguisher, rated not less than 10B, was not provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas were being used on the jobsite. a) Construction site, The Fields at Blue Barn Meadows, Unit 27 - On or about July 22, 2020, employees were utilizing an air compressor and portable generator with internal combustion engines in a location where more than five gallons of gasoline was also placed, but the employer did not provide a readily available fire extinguisher of the necessary rating within 50 feet.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) Construction site, The Fields at Blue Barn Meadows, Unit 6- On or about July 22, 2020, employees were performing residential framing work, approximately 11' 5" above grade, without utilizing any means of fall protection. b) Construction site, The Fields at Blue Barn Meadows, Unit 6- On or about July 22, 2020, employees were performing residential framing work, approximately 9' 1" above lower level, without utilizing any means of personal fall arrest, cover or guardrail system. FDR was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1454968, citation number 1, item number 1 and was affirmed as a final order on 2 July 2020, with respect to a workplace located at 428 North 5th Street, Emmaus, Pa 18049.
