29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) In the Ball Transfer Stamping Area, on or about July 23, 2020 - The employer failed to administer a hearing conservation program including a monitoring program, an audiometric testing program, and training program, as well as make available access to information and training materials when a Production Worker's noise exposure exceeded a dose of fifty percent while operating presses. The Production Worker was exposed to noise at an 8-hour time-weighted average sound level of 87.7 dBA, or, equivalently, a dose of 72.4% during a 410 minute sampling period on September 1, 2020 while operating presses.  b) In the Ball Transfer Stamping Area, on or about July 23, 2020 - The employer failed to administer a hearing conservation program including a monitoring program, an audiometric testing program, and training program, as well as make available access to information and training materials when a Production Worker's noise exposure exceeded a dose of fifty percent while operating presses. The Production Worker was exposed to noise at an 8-hour time-weighted average sound level of 87.3 dBA, or, equivalently, a dose of 69.0% during a 421 minute sampling period on September 1, 2020 while operating presses.

A clear space of not less than 3 feet on all sides was not kept free from storage or combustible construction:  a) In the Powder Coating Area, on or about July 23, 2020 - Employees use an OptiFlex Pro B to spray finish clock housings with POWDURA Urethane Polyester Powder Coating High Gloss Black and Blue Full Gloss inside a Nordson Econo Coat Series II spray booth that did not have a clear space of at least 3 feet on all sides. Empty paint cans, cardboard boxes, and a storage rack with cardboard boxes were stored adjacent to the exterior of the spray booth, as well as a table with solvent stored adjacent to an interior wall of the spray booth preventing cleaning of non-deposited powder.
