29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about July 29, 2020, during the replacement of a sewer manhole at a worksite located on the corner of State Route 83 and Friendsville Road, Wooster, Ohio, the employer did not ensure two employees working in a 9 to 10.5 foot deep excavation were protected from excavated materials falling or rolling into the excavation by placing the materials at least 2 feet from the edge of the excavation or by use of a retaining device.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about July 29, 2020, during the replacement of sewer manhole at a worksite located on the corner of State Route 83 and Friendsville Road, Wooster, Ohio, the employer did not ensure two employees working inside an excavation, with a varying depth of approximately 9 to 10.5 feet, were protected from cave-ins by an adequately designed protection system. The soil would have been classified as a mixture of Type B and Type C ; cohesive soil, loose rock, and stone.
