29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  On or about May 24, 2021, during the replacement of a sanitary sewer at a worksite located at the intersection of Mapleside Road and Mt Overlook Avenue, Cleveland, Ohio, the employer did not ensure an employee inside a trench, with a varying depth of approximately 10 to 10.5 feet, was protected from cave-ins by an adequately designed protection system.  The soil would have been classified as Type "B" cohesive soil.   S.E.T., LLC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.652(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1485703, CITATION NUMBER 01, ITEM NUMBER 02, AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 15, 2020, WITH RESPECT TO A WORK PLACE LOCATED AT THE CORNER OF STATE ROUTE 83 AND FRIENDSVILLE ROAD, WOOSTER, OHIO.
