1910.132(d)(1)(ii) The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: Communicate selection decisions to each affected employee. a. On or about August 4, 2020, at the above addressed worksite, the employer did not communicate to the unit supervisor in Unit 121 D-Train that he was to wear a face shield, instead of goggles, when verifying that the condenser unit is clear of molten sulfur in preparation for the next steps of the shutdown process.

29 CFR 1910.138(a):General requirements. Employers shall select and require employees to use appropriate hand protection when employees' hands are exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasions; punctures; chemical burns; thermal burns; and harmful temperature extremes. a. On or about August 4, 2020, at the above addressed worksite, in Unit 121 D-Train, an employee was verifying a system shut-down of a chemical process by opening a look box lid to confirm there was no chemical flow into the pit. The look box lid was left open, exposing the employee to hand injury from steam and molten sulfur. The employer did not ensure the employee used appropriate hand protection.
