29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  Facility at 66 Broad St, Westfield, MA: On or about May 11, 2020, a written respiratory protection program addressing the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) was not established and implemented to ensure employee protection from exposure to Severe Acute Respiratory Syndrome Coronavirus-2 (SARS-CoV-2) during tasks when respirator use was mandated including, but not limited to, the provision of medication, treatment, feeding, washing, dressing, and providing other care as necessary to residents who were confirmed positive for COVID-19.

29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent:   In the facility at 66 Broad St, Westfield, MA: On or about 05/13/2020, the employer did not record the following workplace injuries or illnesses on the OSHA Form 300 or equivalent for the calendar year 2020.:   a) A Registered Nurse was tested for COVID-19 on 05/11/2020 and was confirmed positive on 05/13/2020.    b) A Certified Nursing Assistant was tested for COVID-19 on 05/11/2020 and was confirmed positive on 05/13/2020.   These two employees worked in the COVID-19 positive ward on the first floor of the facility.
