29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  The employer will not develop and maintain safety and health programs for employees, such as a fall protection program for framing construction work activities.  This most recently occurred on August 5, 2020, at the 8427 Chesapeake Way NW, Pickerington, Ohio jobsite. The employer failed to develop and implement a safety and health program for employees performing framing work onsite.  Jerry Turnbaugh was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.20(b)(1) which was contained in inspection numbers:  1) 1474442, Citation 1  Item 1, Issued on 7/8/2020 2) 1384927, Citation 2  Item 1, Issued on 4/8/2019 3) 1301052, Citation 1  Item 1, Issued on 3/29/2018  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards associated with framing construction work activities.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  The employer will not provide safety and health training for employees.  This most recently occurred on May 7, 2020, at the 8427 Chesapeake Way NW, Pickerington, Ohio worksite. The employer failed to provide safety and health training for employees performing framing work onsite, including, but not limited to, fall protection training and ladder safety training. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer will not provide a fall hazard training program for employees.  This most recently occurred on August 5, 2020, at the 8427 Chesapeake Way NW, Pickerington, Ohio jobsite. 29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  The employer will not ensure that employees use eye protection when exposed to eye hazards during the use of pneumatic nail guns during framing construction activities.  This most recently occurred on August 5, 2020, at the 8427 Chesapeake Way NW, Pickerington, Ohio jobsite. The employer failed to ensure employees used eye protection while installing roof sheathing with the use of pneumatic nail guns. 29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  The employer does not protect each employee from the hazard of falling by the use of fall protection systems.  This most recently occurred on August 5, 2020, at the 8427 Chesapeake Way NW, Pickerington, Ohio jobsite. The employer failed to ensure employees were protected from falls while installing roof sheathing. The employees were not protected by guardrail systems, a safety net system or a personal fall arrest system that complied with this part. Du to this condition, employees were expose to a fall hazard that exceeded 20 feet.
