29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  The employer does not protect each employee from the hazard of falling by the use of fall protection systems.  This most recently occurred on May 23, 2023 on the job site located at Chesapeake Way Lot 35, Pickerington, OH 43147. The employer failed to ensure employees who were performing framing work on the roof of a new build residential home were protected from fall hazards while sheathing and framing the roof, which exposed them to a fall hazard of up to approximately 31 feet.  Jerry Turnbaugh was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1506122, citation number 1, item number 3 and was affirmed as a final order on June 14, 2021, with respect to a workplace located at 841 Village Mill Road, Pickerington, OH 43147.  Jerry Turnbaugh was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1487111, citation number 1, item number 4 and was affirmed as a final order on October 6, 2020, with respect to a workplace located at 8427 Chesapeake Way NW, Lot #22, Pickerington, OH 43147.  Jerry Turnbaugh was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1480136, citation number 1, item number 1 and was affirmed as a final order on August 3, 2020, with respect to a workplace located at 768 Whamcliff Loop NW, Wellington Park Homesite #138, Pickerington, OH 43147.  Jerry Turnbaugh was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1477358, citation number 1, item number 1 and was affirmed as a final order on August 3, 2020, with respect to a workplace located at 8426 Chesapeake Way NW, Lot #4, Pickerington, OH 43147.  Jerry Turnbaugh was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1474442, citation number 1, item number 3 and was affirmed as a final order on August 3, 2020, with respect to a workplace located at 149 Thrush Circle, Pickerington, OH 43147.  Jerry Turnbaugh was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1384927, citation number 1, item number 1 and was affirmed as a final order on November 20, 2019, with respect to a workplace located at 7736 Connor Avenue, Canal Winchester, OH 43110.  Jerry Turnbaugh was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1301052, citation number 1, item number 4 and was affirmed as a final order on April 24, 2018, with respect to a workplace located at 42 West Columbus Street, Lithopolis, OH 43136.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a.  The employer does not protect each employee from the hazards of falling by the use of a training program that enables each employee to recognize the hazards of falling.  The employer does not provide training in recognition of the hazards of falling and the procedures to follow to minimize these hazards.  This most recently occurred on or about May 23, 2023 on the job site located at Chesapeake Way Lot 35, Pickerington, Ohio, 43147 jobsite. The employer failed to develop and implement a fall hazard training program for employees with exposure to fall hazards of up to 31 feet while performing residential framing work onsite.
