29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (Construction Reference 1926.103) NBPL: Building 158: Office 115: An employee was cutting and installing tile to the flooring and walls of restroom area. The employee was working with Rapidset Mortar mix and other products which contained crystalline silica. The employer did not evaluate the respiratory hazard of respirable crystalline silica during the tile cutting and installation processes. This condition exposed employees to a respiratory hazard.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59) NBPL: Building 158: Office 115: An employee conducting tile cutting and installation was not provided training on products such as Laticrete 252 Silver, MAPEI Mapelastic, MAPEI Ultraflex (LHT), and Rapidset Mortar Mix which contain silica by the employer at the time of his initial assignment. The employee was exposed to inhalation hazards.
