29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):   (a)Metro Construction, Inc. at Intersection of 271 Street & Louise Street, Sioux Falls, SD 57032: On or about and at times prior to August 5, 2020, the employer did not ensure that employees conducting work in an excavation were protected from cave-in hazards. An employee was working in an excavation installing 12 inch diameter PVC piping in an excavation that was approximately 10 feet 4 inches in depth which lacked an adequate protective system, such as sloping, benching, or shielding system. This condition exposed an employee to cave-in hazards within an excavation 10 feet 4 inches deep.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift:   (a)Metro Construction, Inc. at Intersection of 271 Street and Louise Street, Sioux Falls, SD 57106: On or about and at times prior to August 5, 2020, the employer did not ensure that daily inspections of a trench that was 10-foot 4 inches in depth were made by the competent person for evidence of a situation that could have resulted in a hazardous condition. The competent person did not identify that the trench was greater than five feet in depth, had vertical walls, and the sloping was inadequate as a protective system. This condition exposed employees to struck-by hazards and crushing injuries associated with trench wall cave-in.

29 CFR  1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face. Such protection shall consist of scaling to remove loose material; installation of protective barricades at intervals as necessary on the face to stop and contain falling material; or other means that provide equivalent protection:  (a)Metro Construction, Inc. at Intersection of 271 Street and Louise Street, Sioux Falls, SD 57106: On or about and at times prior to August 5, 2020, the employer did not ensure the spoil pile was 2 feet from the trench. The excavation measured 10-fott 4 inches in depth on the with the spoils pile on the north and south edge of the trench. This condition exposed the employees to the hazard of the materials falling into the trench or causing the trench to collapse.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in the trench excavation that was 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:  (a)Metro Construction, Inc. at Intersection of 271 Street and Louise Street, Sioux Falls, SD 57106: On or about and at times prior to August 5, 2020, the employer did not ensure that each employee conducting work in the excavation were provided with a safe means of egress from trench excavations, in that a stairway, ladder, ramp or other safe means of egress was not located so as to require no more than 25 feet of lateral travel for employees. The ladder positioned in the trench excavation was approximately 73 feet from where the employees was working in the excavation. This hazard exposed an employee to crushing hazards as a result of not having access/egress within 25 feet of where the work area.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder:  (a)Metro Construction, Inc. at Intersection of 271 Street and Louise Street, Sioux Falls, SD 57106: On or about and at times prior to August 5, 2020, the employer did not ensure that a portable extension ladder used to access the trench excavation had side rails extending 3 feet above the top of the trench, and was secured. This condition exposed three employees to fall hazards of approximately 10 feet.
