29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.   a) Francisco Morales Cruz, at a jobsite located at 231 John Reese Parkway, Pataskala, Ohio 43062: On and/or preceding August 11, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to a personal protective equipment program and a fall protection program for employees conducting roofing work.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Francisco Morales Cruz, at a jobsite located at 231 John Reese Parkway, Pataskala, Ohio 43062: On and/or preceding August 11, 2020, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Roofers were installing roofing materials while using pneumatic nail guns. The employees were not utilizing eye protection, which exposed them to struck-by hazards to the eyes.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Francisco Morales Cruz, at a jobsite located at 231 John Reese Parkway, Pataskala, Ohio 43062: On and/or preceding August 11, 2020, the employer did not ensure employees were protected from falls while engaged in residential roofing activities. Employees were installing roofing materials while exposed to fall hazards of up to 11 feet 3 inches.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   a) Francisco Morales Cruz, at a jobsite located at 231 John Reese Parkway, Pataskala, Ohio 43062: On and/or preceding August 11, 2020,  the employer did not ensure employees were trained on fall hazards or the required procedures to be followed to minimize the hazards while engaged in residential construction activities. Employee were roofing a house without fall protection and did not know and understand the requirements for fall protection, thereby exposed to fall hazards of up to 11 feet, 3 inches.
