29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use (as cross-referenced in Construction Standard 1926.103)  a) Employee(s) were required to wear N95 respirator during removal of  the existing flat roof of  warehouse building at 5 Van Veghten Drive in Bridgewater NJ.  The employer had no written respiratory protection program detailing such topics as selection, inspection & maintenance of respirators, as well as training & medical evaluations of users; exposing employee(s) to respiratory distress during prolonged uses. Condition(s) were noted on or about 10/16/2020.

The employer had not provided for medical evaluation and approval for respirator use by all employee(s) required to wear respiratory protection; exposing employee(s) to respiratory distress during prolonged use. 29 CFR  1926.1101(k)(9)(i):The employer did not institute, at no cost to employees, a training program for each employee who was likely to be exposed in excess of the permissible exposure limit (PEL) and for each employee who performed Class I through IV asbestos operations:  a) As part of contracted roof replacement of a warehouse building at 5 Van Veghten Drive in Bridgewater NJ, employee(s) removed  the old flat roof (Class II work) on the west side of the expansion joint midpoint, for which a bulk sample by the employer indicated asbestos content.  Employee(s) were not provided training on the work practices specific to removal of asbestos-containing roofing material;  exposing them to the health hazard of asbestos.  Condition(s) were noted on or about 8/21/2020.
