OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from crushing hazards: Instances including, but not limited to, the following: a) Jobsite, National Fuel Right of Way N20 close to Birch Road near East Finley Township, PA: On or about August 25, 2020 an employee was exposed to a roll over hazard while operating a Can Am Rubber Tired Outlander Series 450 DPS model All Terrain Vehicle on a slope of approximately 23 degrees while traveling to perform test site readings and related activities.

29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: Instances including, but not limited to, the following: a) Jobsite, National Fuel Right of Way N20 close to Birch Road near East Finley Township, PA: On or about August 25, 2020, during test site reading and related work activities, the employer did not ensure that an employee operating an all terrain vehicle wore appropriate head and face protection by utilizing a proper helmet, exposing the employee to striking or crushing injuries during an ATV rollover incident on a hillside.
