29 CFR  1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:   On or about August 8, 2020, an employee was exposed to a fall of approximately 30 feet while loading materials on the roof of Herd Manufacturing located at 9227 Clinton Road, Cleveland, Ohio 44144.  The employee was working on the roof approximately 2 feet from the edge for approximately 30 minutes and the employer did not ensure that he was using fall protection.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  On or about August 2, 2020, the employer did not establish an energy control program consisting of energy control procedures, employee training, and periodic inspections.  Employees were not protected from the unexpected energization, startup, or release of stored energy while performing servicing and maintenance activities (setup operations) on a mechanical power presses.  Energy sources include, but not limited to, mechanical, electrical, and hydraulic energy.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   On or about September 15, 2020, employees were exposed to an amputation hazard while working on Press #2 during normal parts making processes. The employees would clear the ejection chute in the rear of the press at a distance of approximately 20 inches and the employer did not ensure that point of operation guarding was in place.
