29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a.) On October 7, 2020, the Press Operator operating Press #2, was exposed to continuous noise levels at 321% of the permissible daily exposure (8-hour, time-weighted average of sound level of 90dbA or equivalently, a dose of 100 percent), during the 450 minute sampling period.   b.) On October 7, 2020, the Press Operator operating Press #12, was exposed to continuous noise levels at 391% of the permissible daily exposure (8-hour, time-weighted average of sound level of 90dbA or equivalently, a dose of 100 percent), during the 467 minute sampling period.   c.) On October 7, 2020, the Press Operator operating Press #11 and #15, was exposed to continuous noise levels at 245% of the permissible daily exposure (8-hour, time-weighted average of sound level of 90dbA or equivalently, a dose of 100 percent) during the 446 minute sampling period.   d.) On October 7, 2020, the Press Operator operating Press #16, was exposed to continuous noise levels at 194% of the permissible daily exposure (8-hour, time-weighted average of sound level of 90dbA or equivalently, a dose of 100 percent) during the 461 minute sampling period.

29 CFR  1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  The employer did not develop and implement a monitoring program for employees exposed to 8-hour time-weighted (TWA) sound levels of 85dBA or greater (50%).    a.) On October 7, 2020, the Press Operator operating Press #2, was exposed to continuous noise levels at 321% of the permissible daily exposure (8-hour, time-weighted average of sound level of 90dbA or equivalently, a dose of 100 percent), during the 450 minute sampling period.   b.) On October 7, 2020, the Press Operator operating Press #12, was exposed to continuous noise levels at 391% of the permissible daily exposure (8-hour, time-weighted average of sound level of 90dbA or equivalently, a dose of 100 percent), during the 467 minute sampling period.   c.) On October 7, 2020, the Press Operator operating Press #2, was exposed to continuous noise levels at 321% of the permissible daily exposure (8-hour, time-weighted average of sound level of 90dbA or equivalently, a dose of 100 percent), during the 450 minute sampling period. The employee has been an employee for 1.5 years and never received an audiogram until October 5, 2020.

On October 7, 2020, the Press Operator operating Press #2, was exposed to continuous noise levels at 321% of the permissible daily exposure (8-hour, time-weighted average of sound level of 90dbA or equivalently, a dose of 100 percent), during the 450 minute sampling period.   b.)
