29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Jobsite: On or about September 4, 2020, two employees were installing asphalt shingles on residential roof (new construction) and they were not protected from falling to the ground. In addition, a third employee was tied off but he was tied of in the front with a rock climbing harness. The fall hazard ranged from about 14 feet to 22 feet. The pitch of the roof was about 10 in 12.

29 CFR 1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer shall retrain the affected employee: (a) Jobsite: On or about September 4, 2020, the employer needs to retrain its three employees who were working from a residential roof (installing asphalt shingles) when and how to use proper fall protection when working from a roof.
