29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) M2 Concrete and Excavating Inc., at 2885 N. Eliot St., Denver, CO 80211: On and before September 4, 2020 the employer did not ensure that each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system, in that employees were stripping forms from concrete pillars of an apartment building under construction were not utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately 10-15 feet.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement: (a) M2 Concrete and Excavating Inc., at 2885 N. Eliot St., Denver, CO 80211: On and before September 4, 2020 the employer did not ensure employees were not placed on the top-end of exposed vertical rebar that was protruding from many of the vertical foundation walls. Employees climbed above, stepped over, and walked next to the foundation walls with protruding rebar. This condition exposed employees to impalement hazards.
