29 CFR 1910.28(b)(1)(i): (1) Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. a) On or about 9/15/2020 the employer did not ensure that employees were protected from a fall of greater than 4ft. Employees must check the levels of the silos by getting down on their knees, leaning over the guard rail system, open the sight glass port to check the level in the silo.

29 CFR 1910.30(a)(1): (a) Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. a) On or about 9/15/2020 the employer did not provide training to employees who would be exposed to a fall hazard greater than four feet such as but not limited to the use of extension ladder that are utilized to access the top of tanks for cleaning in the unloading bay and when placing their bodies outside of the guardrails while reaching out to check the level indicators on top of the silos.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a) On or about 9/15/2020 the employer did not provide protective shields or barriers on steam piping that are located in locations such as but not limited to; evaporator area, blending tank D1, blending area tank D2 and blending tank D3. Employees were exposed to scalding/burns when operating or near the steam piping that operates at 45 Psi at a temperature of 292 degrees.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. a) On or about 9/15/2020 the Buhler bagging machine MWPF allowed employees hands to be near the bag clamping area that operates at 14 PSI, this exposed the employees to a caught in hazard.
