29 CFR 1910.178(n)(4): The driver shall be required to slow down and sound the horn at cross aisles and other locations where vision is obstructed. If the load being carried obstructs forward view, the driver shall be required to travel with the load trailing. On or about September 1, 2020, employees of Valley Baker Cooperative Association were not slowing their powered industrial vehicles while traveling through intersections with their vision obstructed.

29 CFR 1910.178(n)(8): Under all travel conditions the truck shall be operated at a speed that will permit it to be brought to a stop in a safe manner. On or about September 16, 2020, employees of Valley Baker Cooperative Association were observed to be operating Crown PE 4500 Series Pallet Trucks at speeds that would not allow the vehicle to be brought to a stop in a safe manner.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about September 16, 2020, the company did not ensure that Crown PE 4500 Series lifts were being inspected prior to be placed into service at the end of shifts while being used on a round-the-clock basis. Operators were only conducting inspections of the lifts when prompted by the onboard InfoLink System every 12 hours.
