29 CFR 1926.251(a)(1): Rigging equipment for material handling shall be inspected prior to use on each shift and as necessary during its use to ensure that it is safe. Defective rigging equipment shall be removed from service.  (A)  The employer did not ensure that defective rigging equipment was removed from service.  At the jobsite located at the bridge construction over the Arkansas River in Nickerson, KS, employees were exposed to struck-by hazards. Employees engaged in material handling operations were exposed to struck-by hazards while moving material with defective nylon slings and metal hooks. Employees were exposed in that the employer did not remove the defective equipment prior to being placed in-use.

29 CFR 1926.251(e)(8)(iii): Synthetic web slings were not immediately removed from service when snags, punctures, tears or cuts were present.  At the jobsite located at the bridge construction over the Arkansas River in Nickerson, KS, employees were exposed to struck-by hazards. Employees engaged in material handling operations were moving material with defective rigging in that the rigging had excessive wear in the webbing, exposing employees to struck-by hazards.

29 CFR 1926.307(d)(1): Pulley(s) with part(s) seven feet (2.128 m) or less from the floor or work platform were not guarded in accordance with the requirements specified in paragraphs  (m) and  (o) of this section:Note:  Pulleys serving as balance wheels (e.g., punch presses) on which the point of contact between belt and pulley is more than 6 ft. 6 in. (1.976 m) from the floor or platform may be guarded with a disk covering the spokes.  At the jobsite located at the bridge construction over the Arkansas River in Nickerson, KS, the crane motor located inside the crane cab had an unguarded pulley, exposing employees to caught-in and amputation hazards. Employees engaged in crane activities as a part of their daily duties were exposed to caught-in and amputation hazards in that the employer did not provide a guard for the pulley located inside the cab of the American Crane.

At the jobsite located at the bridge construction over the Arkansas River in Nickerson, KS, the crane motor located inside the crane cab had an unguarded belt, exposing employees to caught-in and amputation hazards. Employees engaged in crane activities as a part of their daily duties were exposed to caught-in and amputation hazards in that the employer did not provide a guard for the belt located inside the cab of the American Crane.

29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level:  At the jobsite located at the bridge construction over the Arkansas River in Nickerson, KS, employees were exposed to fall hazards.  Employees walking and working near the cofferdam were exposed to fall hazards of approximately 20 feet in that the guardrail system was not adequate.
