29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: On or about October 2, 2020, on the east side of the construction site where employees were exposed to a fall hazard while working from an aerial lift leveling a cedar beam without wearing a harness with a lanyard attached to the basket.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about March 17, 2020, on the east side of a building being constructed, an employee was exposed to a fall hazard exceeding six feet when working on a fourth floor balcony installing a cedar beam without a fall protection system in place. Jose Gracias was previously cited for a violation of an equivalent Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1241925, citation number 2, item number 1 and was affirmed as a final order on October 10, 2017 with respect to a workplace located at 2323 Wolf Ranch Parkway, Georgetown, TX 78628.
