29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Broadview Place: On or about October 2, 2020, and at times prior thereto the controlling employer, Perryman Construction Management, Inc., did not ensure sub-contractor(s) workers were protected from fall hazards while accessing and working on various levels of each unit. Guardrail systems were not in place and/or incomplete at the second and third level balconies and on lower roof levels where subcontractor employees were performing work activities. b) Broadview Place: On or about October 2, 2020, and at times prior thereto the controlling employer, Perryman Construction Management, Inc., did not ensure that roofing sub-contractor(s) workers were protected from fall hazards while performing roofing activities on a three story building.
