29 CFR 1926.302(b)(2): Safety clips or retainers were not securely installed or maintained on pneumatic impact (percussion) tools to prevent attachments from being accidentally expelled: On or about October 5, 2020, and at times prior thereto, employees used a SULLAIR Model No. 185DPO CA, with a hose attached to a jackhammer without safety clips or retainers to prevent tools from being accidentally disconnected. Employees were exposed to struck-by and whip-by hazards.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. On or about October 5, 2020 and at times prior thereto, the employer did not install ensure engineering controls were used, alternative work practices or respiratory protection was provided and used for employees performing pavement horizontal drilling work. Employees were potentially exposed to respiratory illnesses and/or adverse health effects from concrete dust.
