29 CFR  1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:   a) Jobsite located at 1920 Gerritt Street, Philadelphia, PA.: Employees working on the 2nd floor of a residential building near or at the wall openings were not provided with a fall protection system; thus exposing employees to falls of approximately 10 feet.  Condition was observed on or about 06 October 2020.

29 CFR  1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  a) Jobsite located at 1920 Gerritt Street, Philadelphia, PA. 1st Floor: Employees were exposed to fall hazards in that, the employer did not ensure a  handrail was provided for the stairways, which had approximately 13 risers.  Condition was observed on or about 06 October 2020.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  a) Jobsite located at 1920 Gerritt Street, Philadelphia, PA.: The employer did not ensure that the employees utilized the Werner 6 foot self-supporting ladder per the manufacturers recommendations. An employee used a Werner ladder by standing on the top rung and also the rear side rails, thus exposing the employees to fall hazards of approximately 6 feet.   Condition was observed on or about 06 October 2020.

29 CFR 1926.252(c): All scrap lumber, waste material, and rubbish was not removed from the immediate work area as the work progressed:  a) Jobsite located at 1920 Gerritt Street, Philadelphia, PA.: The employer did not remove scrap lumber, remove protruding nails, broken glass, and other debris in passage ways of the work areas; thus exposing the employees to impalement, and trip and fall hazards.  Condition was observed on or about 06 October 2020.   Mexcon, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.252(c), which was contained in OSHA inspection number 1169195 citation number 1, item number 1, and was affirmed as a final order on 02/14/2017, with respect to a workplace located at 718 Christian Street, Philadelphia, PA 19132.
