On or about October 7, 2020 employees engaged in residential framing operations were exposed to struck-by hazards while operating pneumatic nail guns without eye protection. 29 CFR 1926.102(a)(3): The employer shall ensure that each affected employee who wears prescription lenses while engaged in operations that involve eye hazards wears eye protection that incorporates the prescription in its design, or wears eye protection that can be worn over the prescription lenses without disturbing the proper position of the prescription lenses or the protective lenses.  On or about October 7, 2020 employees engaged in residential framing operations were exposed to struck-by hazards while operating pneumatic nail guns without eye protection that can be worn over prescription eyeglasses.  No abatement certification or documentation required for this item.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.     On or about October 7, 2020 the employer was observed using a field designed wooden platform on a Lull forklift 22 feet high as a scaffold platform for personnel to perform residential framing activities. The Lull forklift was not designed to be used to lift personnel nor to be used to support scaffold platforms, exposing employees to fall and struck-by hazards.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.    On or about October 7, 2020 the employer used a forklift to raise a wood basket to lift employees 22 feet high. Employees were observed performing framing operations in a field designed platform elevated by a Lull Forklift that was not properly attached and secured to the forklift, exposing employees to fall and struck-by hazards.      Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    On or about October 7, 2020, employees were exposed to fall hazards approximately 25 feet high while engaged in residential framing activities.  Fall protection was not being utilized while performing framing operations.       Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).    P & T Custom Homes Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 1214267, citation 1, item number 1 and was affirmed as a final order on April 19, 2017 with respect to a workplace located at 11 Mockingbird Ln., Oak Brook, IL.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  On or about October 7, 2020, the employer failed to certify that employees had been trained to recognize and minimize fall hazards.  Employees were exposed to fall hazards approximately 25 feet while performing framing activities on a residential structure without using fall protection.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
