On or about October 8, 2020, for the building site, the employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials, and equipment to be made by a competent person for fall hazards and steel erection hazards.  Employees worked at the 2nd floor and were exposed to falls greater than 6 feet to a lower level.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.   On or about October 8, 2020, the employer did not ensure that employees wore protective helmets while working below steel erection activities.  This exposed the employees to struck-by hazards from impact, or from falling or flying objects.  a.	A welding employee was working from the basket of a JLG extensible boom lift, near the steel beams of the building canopy, and was not in use of a protective helmet. b.	Two employees, without protective helmets, were standing in the parking lot below the welder in the JLG extensible boom lift basket.  c.	Two temporary labor employees were not in use of protective helmets when climbing ladders through the floor openings at the 1st and 2nd floors.     d.	A temporary labor employee did not wear a protective helmet while working below the welding area moving scaffold parts from the east exterior side of the building to a pickup truck.   e.	An employee, forklift operator, was not in use of a protective helmet when exited the forklift under the area where the welders were working.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:     On or about October 8, 2020, at the front of the building, the employer did not ensure that the employees working from the aerial lift basket were in use of fall protection harnesses and lanyards.  The employees were exposed to falls greater than 6 feet to a lower level.

On or about October 8, 2020, at the 2nd floor of the building, the employer did not ensure that an employee was in use of a personal fall arrest system, positioning device, or fall restraint equipment necessary to be able to be tied off and was not provided with guard rail systems or safety net systems when connecting steel beams at heights over 15 feet and up to 30 feet above a lower level.  The employee was exposed to falls greater than 15 feet to a lower level.
